50/50 my ass. They cant blatantly say regardless of reason that an accident that took place in a parking lot is always the fault of both parties. You will have to argue with their insurance company if they want to put fault at 50/50, which why wouldnt they want to? It saves them money. If that is the case you can either bend over and lube yourself up, argue with them yourself or get a lawyer or go through your own insurance and let them battle it out.

Repair costs are debatable. Most insurance companies get a discount from their authorized body shops. Your options are use their shop to repair the whole thing in which case the cost doesnt matter if youre getting it fixed, choose your own body shop which they have to cover the cost anyway, or argue with them on the amount til you settle on something and take a check to fix it however you wish.

Cut it off and weld a new one on I think
Not needed for the small dent in that corner. Thats only done when its major damage and not worth repairing.

Thanks for the help.. Hopefully the witness can help out. I already spoke to the body shop, now just awaiting the go-signal from their insurance. She had All-State. I don't think i'm in good hands. Lol
