I bet you would have lost, too. I suggest you familiarize yourself with California laws before jumping to the conclusion that Sheriff deputies cannot pull you over on the freeway. Sure, CHP officers are trained to specialize in highway patrol, but I, personally, haven't come across a law that states highways are out of a Sheriff deputies' jurisdiction. They all work under the State. Correct me if I'm wrong, though.

Let's be honest...you aren't mad because a SHERIFF pulled you over -- you're mad that you got pulled over at all, no? I would probably be a little irritated myself. That comes along with the territory, though. I'm not usually a preacher, but don't break the law if you don't want to deal with the consequences. It's common sense.

For the record, CHP could ticket you for going anywhere over the speed limit. Most won't if you're going 5-8MPH over the limit, but they could is my point. Speedometers aren't always acurrate, so I like to think that 5MPH (give or take) is fair. Even then, you have to accept the risk that you COULD be cited if the cop wants to make a point. Try going 80MPH at the end or first of the month when they're more "motivated" to hand out a citation. lol Just because you haven't ran into one that has pulled you over for 75-80MPH, it doesn't mean they won't next time, just to prove a point.

Going with the flow of traffic helps you "blend in" with everybody else, but remember that officers usually pull over only ONE car at a time. You're just playing the odds. Don't be upset if it's YOU they focus on.







Yeah, there is such thing as a "Basic Speed Law," but you can't always look at what you WANT to see and interpret it for how you hope it to be and all of a sudden it's right or will hold in court. The last part in the Basic Speed Law: "...and in no event at a speed which endangers the safety of persons or property." If you're exceeding the MAXIMUM speed limit, that's endangering the safety of persons/property. It doesn't matter how "in control" of your vehicle you think you are. You're not in control of everyone around you, things in the road, etc. Speeding increases your stopping distance, as well. They don't post speed signs as a courtesy to you. It's what the State has determined to be the safe speed limit for that road.









Wouldn't it make more sense to speed in the daytime when you could actually see everything instead of at night just because "traffic is clear," in your opinion? It's California...there are people out at all times. My risk of dying shouldn't increase simply because I happen to get on the right road at the wrong time.


I won't lie. I speed on the highway a lot. If I ever get a ticket, it will probably be because I deserved it, though. Speeding is speeding, regardless of what time of the day it is and who's around. It's unsafe to other people and to yourself. However, if you do speed, don't bitch about it when you get caught. With your attitude about the whole situation, I personally think he let you off easy. :twocents:

of course there are restrictions to the speed law. I'm not saying it's okay to do 100 and get pulled over and say you were obeying the basic speed law. but if traffic moves along at 80mph in the fast lane, and you're going 80, with a safe distance buffer zone with the car in front of you, and still aware of your surroundings, you cant be punished for it. Of course there is nothing to stop an officer from writing you a ticket, but if they're pulling someone over just because, then it is of course unfair. I've driven with my radar, when a mustang did a fly-by, and he got pulled over, 1am, very little cars, even I consider that reckless. So there is common sense that applies to the state's basic speed law, being smart and knowing the law is one thing, misinterpretation of it is another.

Jurisdiction is a tricky thing, my friend is interning for SF's sheriff's dept, and he said for example Bart Police has jurisdiction anywhere there's a bart system. CHP has jurisdiction over CA, etc etc.

Actually it varies from state to state. Here in Iowa state troopers, city cops and sherrifs have the right to give you a citation where ever they want in their county. Just friday they had a speed trap on the interstate and there were only sherrif vehicles ( this is state trooper grounds).

He let you off with a warning, didn't he? I'd consider that a break. If he wanted to give you a hard time, he could have harassed you a whole lot more. How was he supposed to know you were sick (like it'd even matter to him lol)? I feel you, though. Bad days happen. It's just unfortunate when people blame others for their actions. We're all adults. He didn't set your cruise control to 75. He was doing his job.

A ticket = punishment, IMO. Maybe not in the whips and chains type of punishment, but nevertheless, it's punishment.

You're saying that you "can't be punished" for going 80, but in the very next line, you said, "Ofcourse there is nothing to stop an officer from writing you a ticket..." lol Soooooooo, Stevenson...that means it's very possible. :p They can if they want to. Just because a lot tend to look the other way when you're going 75MPH (give or take a few), it doesn't mean you're always off the hook. You'll catch one who's trying to meet quota or just plain out been having a bad day.

Most freeways in Cali are 65 MPH maximum, some 70. I don't take my chances, though. If I see a cop or don't want to get pulled over, you can bet your ass that I'm slowing down to 65-72. Having a radar detector doesn't hurt, either. lol


All I'm saying is that if you exceed the maximum speed limit, you are choosing to take the risk of a ticket, which is fine. Just don't blame it on the cop when you get one, though. Use common sense.

it's weird how an officer would make you get out of the car without any suspicion except for speeding though. As for me, getting tickets is one thing, getting out of them.. well is fun. Sometimes cops are straight up aholes, especially when they have a quota to fulfill. Last time I got pulled over and ticketed for making a left turn out of an in-n-out when there were these little signs that said no left turn. I fought it, and won, $146 refunded to my bank acct.

Last time I got pulled over and ticketed for making a left turn out of an in-n-out when there were these little signs that said no left turn. I fought it, and won, $146 refunded to my bank acct.
Yea, that just pissed me off cause out of all those other speeding tickets i got, i was never told to step out of my vehicle. He probably thought i was drinking since it was a Saturday night, or he just wanted to be an asshole to me..

If I was a cop, I'd probably be real fucking paranoid, too. lol Do you not watch the news and all the murders?? Or Cops? People can be vicious. He was just protecting himself. You can't always tell a psycho from a normal person.

I just think it's a little childish how people can be so quick to bash "pigs" sometimes. Don't get me wrong, I'm not their #1 fan by any means and I do have my moments when it comes to shit talking and cops. People shouldn't jump of the bandwagon all the time, though. Know your state laws and whether you've broken them. It's ALWAYS wise to know what they can and cannot legally do before you assume the "victim" role. It keeps ya under the radar, IMO.

Thanks but i wasnt bashing on him like calling him a fucking "pig" ect. I know they're out there to do their job and i have nothing against it. Just felt like posting because i was upset at the moment and also because he made me steped out of the car just for speeding.. But like i said he probably thought i was drinking or so since it was a saturday night.

dunno bout cali but in GA the local sheriff dept patrols the part of the interstate that runs through that county, along Georgia state patrol, ...city police are restricted to the city limits ...but in your case, EVEN if he was out of his jurisdiction, he can and most likely will take action, if he feals you are a threat, and a long drawn out battle over territorial jurisdiction would be lost, and a waste of time....take the warning and walk it off bro, hope you get better though!

They can pull you over know matter where you are around here. They can do it outside their own county if there is sufficient reason for it

as i see it, its all based on the cop, city, hywy, sheriff, etc they can pull you over for no apparent reason but they still have to call it in, you can be doing the speed limit minding your own and bam out of no where, if you give them a reason to, they will act

2. sheriffs can pull you over as long as you are int their county, i got rolled by one on 99 in yuba city for weaving slightly in February (it was 1am and i was driving back from palm springs)
3. keeping up with traffic will never get you off in court, tried it in July 06 when i got 80 in 65 on 99 near merced
4. again be glad it wasnt the chp, they got me in febuary 07 with the plane on i5, 87 in a 70, pulled me and 11 other cars over at once.

notice a pattern here? Every time i go to the central valley i get pulled over, its like the departments down there all of a sudden got a lot of funding or something. I would pull the "profiling" card, but they have never said anything about my cars modifications so it was cause i was doing something wrong straight up.
