The Age Discrimination in Employment Act of 1967 said:
PROHIBITION OF AGE DISCRIMINATION

SEC. 623. [Section 4]

(a) Employer practices

It shall be unlawful for an employer-

(1) to fail or refuse to hire or to discharge any individual or otherwise discriminate against any individual with respect to his compensation, terms, conditions, or privileges of employment, because of such individual’s age;

(2) to limit, segregate, or classify his employees in any way which would deprive or tend to deprive any individual of employment opportunities or otherwise adversely affect his status as an employee, because of such individual’s age; or

(3) to reduce the wage rate of any employee in order to comply with this chapter.

(b) It shall be unlawful for an employment agency to fail or refuse to refer for employment, or other­wise to discriminate against, any individual because of such individual’s age, or to classify or refer for employment any individual on the basis of such individual’s age.
This is the main reason as to why you should never put your age on a resume. Most employer, staffing agencies, etc. will immediately trash any resume with a DOB or age on it to completely avoid all aspects of this law and possible suits against them.

The only exceptions are in State and Federal employers.

I understand in a way kind of, because when you have an office full of young girls it's drama like high school, which is what I don't want. Thats why I want to work there because everyone is mature because there so old! lol. His assistant is 65 and one of his hygienist is 50.

What most people do to get around this is to require certain lengths of experience. He could list job openings as 15 years experience to required get around hiring young people.

But strictly putting an age limit on the job can land him some nice lawsuits.

These days your applications will be thrown out without a second breath for just about everything.
