You could probably walk right into walmart and get it no problem.
When I bought mw3 there was a Massive line outside gamestop and since it was midnight I rolled over to walmart because they're less that a quarter mile apart, Walked right in they had it in a box on the counter, Nobody was there but me, I payed for it went home and was playing it by 12:15.

You can pre order up to 9pm. What they do is divide everyone into groups then they go in group by group. Once it hit midnight I waited maybe 15 minutes to go in and get my copy and I was in group 12 out of 13.
