Not to be a dick or anything but you must have been misinformed about the third brake light. All it takes to look up the law is a quick Google search or a call to the DMV. Besides ... the third brake light looks really bad.
The only way you can get ticketed here in California is if the third brake light is not working. If it came from the factory, you need to replace the burned out third brake light. If it is an aftermarket third brake light, you can simply remove it. But there is no such law that requires a car to have a third brake light.
So you are perfectly fine removing your wing (even if it has a third brake light) and putting on a type R wing with no third brake light. I have had my type R wing for a long time and been pulled over many many times.
